  1. Agreement

This contract contains the entire agreement between the Client and Anastella Photography. It is agreed that the terms set out in this contract constitute the full understanding between Anastella Photography and the individual signing the contract, referred to hereafter as "The Client." No modification or variation of this contract shall be effective unless both parties agree to the changes in writing for an individual project.

  1. Child Protection Policy

Anastella Photography is committed to the highest standards of child protection. All photographs involving children will be handled with the utmost care and in full compliance with child protection laws and best practices. The Client acknowledges that all images of children will only be used by applicable laws, and the Photographer will seek prior written consent for any promotional use of such images.

  1. Client Responsibilities

The Client agrees to ensure that the church, venue, and any other relevant parties are made aware of the Photographer’s presence and services before the event. It is the Client's responsibility to notify these parties and obtain any necessary permissions for the Photographer to perform their duties.

  1. Cancellation & Refunds
  • If cancellation occurs less than 2 months before the event date, no refund will be provided.
    • If the Photographer is unable to perform due to illness, accident, or other unforeseen circumstances, reasonable efforts will be made to secure a replacement photographer. If a suitable replacement cannot be found, the Client will receive a full refund of the amount paid, including the deposit.

  1. Payment Terms
  • The Client agrees to pay the full balance for the photography services provided. A non-refundable retainer fee of €50 (or more, if desired by the Client) is required to secure the Photographer’s services. The remaining balance is due before or on the day of the event. The balance may be paid in instalments at the Client’s discretion.
    • The Photographer reserves the right to withhold delivery of the final images until full payment has been received. If the Client refuses to pay the balance, the Photographer may cancel this Agreement and forfeit the non-refundable retainer.

  1. Delivery Schedule
  • The Photographer agrees to deliver the final edited photographs within two (2) weeks following the event date. The Client understands that additional time may be needed for editing and retouching to ensure the highest quality of images. If an unforeseen circumstance arises that prevents timely delivery, the Photographer will notify the Client and provide a revised date.
    • All final images will be uploaded to an online platform, where the Client will be given access via a unique password. The Client should download the images promptly after receiving the link to prevent any loss of access.

  1. Lost Photos/Access

If the Client loses downloaded photos or loses access to the online gallery, the Client may contact the Photographer to recover the images free of charge.

  1. Copyright & Usage Rights
  • The Photographer retains the copyright to all images taken during the communion event. The Client is granted a non-exclusive license to use the images for personal purposes such as printing and sharing on social media. The Client may not use the images for commercial purposes without the written consent of the Photographer.
    • The Photographer reserves the right to use the images in their portfolio, website, social media, and marketing materials unless the Client requests otherwise in writing before the event date.
    • The Client acknowledges that the Photographer is under no obligation to provide unedited or RAW images.

  1. Creative Control

The Client agrees to allow the Photographer creative freedom in terms of photography style, editing, and retouching. Any specific requests by the Client regarding image style or edits must be communicated in writing before the event date.

  1. Additional Hours

If the Client requests additional hours of photography beyond the agreed-upon time, an additional charge of €50 per hour will apply.
