1. Agreement
This contract contains the entire agreement between the Client and Anastella Photography. It is agreed that the terms set out in this contract are the total agreement made between Anastella Photography and the person signing the contract, referred to from here as ‘The client’, and that no variation or modification of this contract shall be effective unless changes to it for an individual project are agreed by both parties in writing.
2. Cancellation & Refunds
- If cancellation occurs within less than 3 months of the wedding date, no refund will be provided.
- If the photographer cannot perform due to illness, accident, or other unforeseen circumstances, the Photographer will make reasonable efforts to secure a replacement photographer. If a replacement cannot be found, the Client will receive a full refund of the amount paid, including the deposit.
3. Payment
- The Client agrees to pay the remaining balance for the photography services provided. A non-refundable fee of €200, or more if the couple wishes, is required to secure the photographer's services for your wedding day, and the remaining agreed-upon balance is due before or on the day of the wedding. The balance can be paid in installments as opposed to paying the bill directly before the wedding day.
- The photographer reserves the right to withhold delivery of the final photos until all payments have been received. If the client refuses to pay the balance, the photographer reserves the right to cancel this Agreement, and the non-refundable retainer will be forfeited.
4. Delivery Schedule
- The Photographer will deliver the final photos to the client within 3-7 weeks from the wedding day. The client understands that the photographer may need additional time to edit and retouch the photographs to ensure the highest quality and that the photographer will not compromise quality for speed. If the photographer is unable to deliver the completed photographs within the agreed-upon time frame due to unforeseen circumstances, in that case, the photographer will notify the client as soon as possible and provide a revised delivery date. The client acknowledges that the delivery date is an estimate only and that the photographer will not be held liable for any delays beyond their control. All images will be uploaded into an online platform and set with a unique password that only the client and the photographer can access. The link to access the client’s photos will be sent to the client by private message as soon as editing and retouching are finished. The client should download the photos to any device (phone or computer).
5. Lost photos/access
- If it happens that the client loses downloaded photos or loses access to them on the online platform, the client can always get in touch with the photographer, and all the pictures will be recovered to the client free of charge.
6. Copyright & Usage Rights
- The photographer retains the copyright to all images taken during the wedding. The client is granted a license to use the images for personal purposes (e.g., printing, sharing on social media). The client agrees not to use the images for commercial purposes without the photographer’s written consent.
- The photographer may use the images in their portfolio, website, social media, and marketing materials unless the client requests otherwise in writing before the wedding day.
- The photographer reserves all rights over RAW, unedited photos, and does not have to comply with the client's request for RAW photos.
7. Creative Control
- The client agrees to give the photographer creative freedom when it comes to photographing, editing, and retouching images, with any specific requirements made in writing by the client before the agreed event day.
8. Client Responsibilities
The Client agrees to:
- Provide the photographer with the necessary information regarding the wedding schedule, locations, and any special requests or preferences.
- Ensure that key people, such as the wedding planner, venue coordinator, and family members, are aware of the photographer’s presence and the need for cooperation.
- Notify the photographer of any changes to the schedule or location promptly.
9. Additional Hours
If the client requests the photographer to stay beyond the agreed-upon time on the wedding day, an additional charge of €150 per hour will be added to the total bill.
10. Break
As standard, your photographers' break time on the day of your wedding will be for 60-90 minutes from when hotel staff /caterers start serving your main meal. No photography will take place during this break, and a hot meal must be provided for the photographer (s) at this time. Bar food is perfect so long as the bar is easily accessible from the area where your meal is being served.
If there are any special events scheduled to take place during your meal time that you would like to have photographed, prior agreement must be made with Anastella Photography no less than 7 days in advance. In such instances, a hot meal must be provided for the photographer(s) in the ballroom or function room where the event is being held.
Should it become necessary for the photographer(s) to leave the venue to obtain a hot meal, you will be informed on the day. In this case, a break period of up to 120 minutes will commence from the time of notification, during which photography services will be temporarily unavailable.
