- Agreement
This contract contains the entire agreement between the Client and Anastella Photography. The terms set out in this contract are the complete agreement between Anastella Photography and the Client, and no variation or modification of this contract shall be effective unless both parties agree to it in writing for an individual project.
- Cancellation & Refunds
- If cancellation occurs less than 2 months before the event date, no refund will be provided.
• If the Photographer cannot perform due to illness, accident, or unforeseen circumstances, reasonable efforts will be made to secure a replacement photographer. If a replacement cannot be found, the Client will receive a full refund of the amount paid, including the deposit.
- Payment
- The Client agrees to pay the remaining balance for the photography services provided. A non-refundable fee of €150 (or more, if desired by the Client) is required to secure the Photographer’s services. The remaining agreed-upon balance is due before or on the day of the event. The balance can be paid in instalments if preferred by the Client.
• The Photographer reserves the right to withhold delivery of the final photos until all payments have been received. If the Client refuses to pay the balance, the Photographer reserves the right to cancel this Agreement, and the non-refundable retainer will be forfeited.
- Delivery Schedule
- The Photographer will deliver the final photos to the Client within 4 weeks from the event date. The Client understands that the Photographer may need additional time to edit and retouch the photographs to ensure the highest quality. The Photographer will not compromise quality for speed. If the Photographer is unable to deliver the completed photographs within the agreed-upon time frame due to unforeseen circumstances, the Photographer will notify the Client as soon as possible and provide a revised delivery date.
• All final images will be uploaded to an online platform with a unique password that only the Client and Photographer can access. The link to access the photos will be sent to the Client by private message once editing and retouching are complete. The Client is responsible for downloading the photos to their device (phone or computer).
- Lost Photos/Access
If the Client loses downloaded photos or loses access to them on the online platform, the Client can contact the Photographer, and all photos will be recovered free of charge.
- Copyright & Usage Rights
- The Photographer retains the copyright to all images taken during the event. The Client is granted a license to use the images for personal purposes (e.g., printing, sharing on social media). The Client agrees not to use the images for commercial purposes without written consent from the Photographer.
• The Photographer may use the images in their portfolio, website, social media, and marketing materials unless the Client requests otherwise in writing before the event.
• The Photographer reserves all rights over RAW, unedited photos, and does not have to comply with requests for RAW images.
- Creative Control
The Client agrees to give the Photographer creative freedom when it comes to photographing, editing, and retouching images. Any specific requests regarding image style or edits must be communicated in writing before the event date.
- Client Responsibilities
The Client agrees to:
• Provide the Photographer with the necessary information regarding the event schedule, locations, and any special requests or preferences.
• Ensure that key people of the event are aware of the Photographer’s presence and the need for cooperation.
• Notify the Photographer of any changes to the schedule or location promptly.
- Additional Hours
If the Client requests the Photographer to stay beyond the agreed-upon time on the event day, an additional charge of €50 per hour will be added to the total bill.
- Agreement Modifications
Any amendments to this Agreement must be made in writing and signed by both parties.
